Welcome to Plarda Labs. These Terms and Conditions ("Terms") govern your use of our website, products, and services, including RunPitch and other platforms operated by Plarda Labs Limited ("we," "our," or "us"). By accessing or using our services, you agree to be bound by these Terms.

1. Service Description

Plarda Labs operates RunPitch, an AI-powered proposal generation platform designed to help freelancers create professional proposals for freelance job platforms like Upwork. Our service uses artificial intelligence to analyze job postings and generate personalized proposals based on user profiles and skills.

2. User Eligibility

To use our services, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into binding agreements
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials

3. Account Responsibilities

As an account holder, you are responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access
  • Ensuring your account information is accurate and up-to-date

4. Subscription Plans and Billing

We offer the following subscription plans:

  • Starter Plan: $5/month
  • Pro Plan: $15/month
  • BYOK Plan: $3/month (Bring Your Own Key)

Subscriptions are billed monthly and automatically renew unless cancelled. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. For refund requests, please refer to our Refund Policy.

5. Acceptable Use Policy

You agree not to:

  • Use our services for any unlawful purpose
  • Share your account credentials with others
  • Attempt to circumvent any usage limits or restrictions
  • Use automated tools to access our services without permission
  • Generate content that is harmful, abusive, harassing, or discriminatory
  • Misrepresent the AI-generated proposals as human-written when required to disclose
  • Use our service to spam or send unsolicited communications
  • Reverse engineer or attempt to extract our AI models or algorithms

6. Intellectual Property Rights

Our Property: The service, including its design, features, and functionality, is owned by Plarda Labs Limited and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

Your Content: You retain ownership of the profile information and content you provide. The proposals generated using your information are licensed to you for your personal and professional use.

7. AI-Generated Content Disclaimer

Our service uses artificial intelligence to generate proposal content. While we strive for accuracy and quality, you acknowledge that:

  • AI-generated content may not always be perfect and should be reviewed before submission
  • You are responsible for verifying the accuracy of generated proposals
  • We do not guarantee that proposals will result in successful job applications
  • The quality of output depends on the quality of input provided

8. Limitation of Liability

To the maximum extent permitted by law, Plarda Labs Limited shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, or business opportunities
  • Any damages arising from your use or inability to use our services
  • Content generated by our AI systems
  • Third-party actions or policies, including freelance platforms

Our total liability shall not exceed the amount you paid for the service in the twelve (12) months preceding the claim.

9. Service Availability and Modifications

We strive to maintain service availability but do not guarantee uninterrupted access. We reserve the right to:

  • Modify, suspend, or discontinue any part of our services
  • Update these Terms at any time with notice to users
  • Change pricing with advance notice to existing subscribers
  • Implement scheduled maintenance that may temporarily affect availability

10. Account Termination

We may suspend or terminate your account if you:

  • Violate these Terms or our acceptable use policy
  • Engage in fraudulent or illegal activity
  • Fail to pay subscription fees when due
  • Abuse our services or act in a way that harms other users

Upon termination, your access to the service will be revoked and your data may be deleted in accordance with our Privacy Policy.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Lagos, Nigeria.
